Summary
This investigation report came about in response to community disquiet about the way in which swimming coach Scott Volkers was arrested on sexual misconduct charges and then had all charges against him dropped by the prosecution before coming to trial. The CMC’s role was not to decide the guilt or innocence of Scott Volkers or whether the prosecution’s decision was correct or not — but rather to determine whether there was any misconduct in the initial police investigation or the subsequent prosecution. The investigation found no evidence of misconduct. However, it did find ‘more defects than one would normally expect to find in an examination of a matter of this kind.
